Changes in Public Procurement Law: price is not the most important


Polish Radio: These are the last days to comment on the draft changes in the public procurement law. This may be a revolution in tenders. The ordering party who rejects the offer will have to justify it and after the order will have to evaluate it. This is a departure from the price criterion, which is the bane of public procurement.

According to the new regulations, all procurement announcements will be included in the Public Information Bulletin. All this is to encourage companies to take part in tenders. However, the employers of the Republic of Poland point out that the new law does not give contractors the possibility to influence the shape of the contract. Attorney Jakub Pawelec indicates that in the project, admittedly, there has been a record of consultations, but it may turn out to be outdated, because there is no obligation to organize such consultations. In his opinion, the provision should be "sharpened" so that the contracting authority would be obliged to organize such consultations, if potential contractors express interest in them.

The consultation of the new law will last until February 23. Unofficially, it is said that the government has to deal with the project before the holidays. The new law will come into force from January next year.
