House on divided ground

On March 15, 2019, in the supplement of Rzeczpospolita 'kancelarie rp', an article by Milena Sokołowska from the Real Estate and Construction team of the Law Office M.Mazurek i Partnerzy Radcowie Prawni sp.p. was published. The author pointed out that in the case of the foundation of the building on geodesy divided into two plots, the legal act consisting in the sale of ownership of one of these plots without division located on building plots according to vertical planes, synchronized with the division of land is valid, if the plots managed in this way at the time of the transaction are covered by separate land and mortgage registers. However, when a single joint land and mortgage register is kept for land plots, the transaction should be preceded by the above division of the building with the land. More at:
