“Rubbish tenders” – Constitutional Tribunal is right

On 26 February 2014 the Constitutional Court in the closed session discontinued the proceedings (file number K 52/12) upon petition of the City Council of Inowrocław to examine the constitutionality of the provisions of Article 6d and Article 6e of the Act of 13 September 1996 on maintaining cleanliness and order in communes. These provisions create a regulation enforcing an obligation on the municipality to conduct  tender procedures in order to select an entity which will collect municipal waste from property owners. Today, it is clear that a municipal company can collect municipal waste if it wins the tender.

In view of the arising comments which asses the judgment mentioned above, Jakub Pawelec, PhD discusses the substance and consequences of the Court's ruling.
