Status quo maintained

An article entitled: Status quo preserved. 'In house' in the new Directive was published in Przegląd komunalny No. 8/2014 (275). The author, Dr Jakub Pawelec, partner in our law firm, refers to the issue of internal procurement, the so-called in house procurement, in the context of Article 12 of the new Directive on Public Procurement (2014/24/EU), noting the need for a strict interpretation of the regulation, taking into account not only the jurisprudence of the Court of Justice of the EU but also the specificities of national regulations governing the status and functioning of the service providers in the waste market e.g. the legal nature of public utility companies. The article provides a valid input to the ongoing discussion on the exceptions to the rules for public procurement and pays particular attention to the wider context of assessing the entities’ compliance with the conditions provided for by Article 12 in Directive 214/24/EU. The article shows the importance of proper understanding of the different criteria for in-house procurement and the possible consequences of too broad interpretation of them in isolation from the legal reality of functioning entities in the market.
